A Chesapeake doctor and his wife are under arrest, facing a 91-count federal indictment unsealed Wednesday in the U.S. District Court in Norfolk.

Sidney S. Loxley, 62, and his wife, 39-year old Carol Dean Loxley, were also arrested Wednesday.

 A federal grand jury returned the indictment last month. In it, Dr. Loxley, his wife, and Orthopedic Surgeons, LTD are charged with 83 counts involving controlled substances, including conspiracy to traffic and trafficking resulting in death; seven monetary counts, including laundering and transactions in criminally derived property; and one count of removal of property to prevent seizure.

If convicted on all counts, Dr. Loxley could face a maximum sentence of life imprisonment and a fine of $1 million. Carol Loxley could face a maximum of 20 years in prison and a $1 million fine.

A federal magistrate ordered the couple jailed without bond Thursday pending a hearing next week.

Dr. Loxley is accused of prescribing Demerol, Dilaudid, methadone, OxyContin and other drugs by the hundreds to patients. The indictment says four patients died in 2003 within days of receiving prescriptions for heavy doses of painkillers.

Loxley's attorney, Andrew Sacks, says the doctor was only trying to help patients suffering from chronic pain.

It was last June when federal search warrants were served on Dr. Loxley's home, offices, and vehicles. Federal officials say the search warrants were a result of an investigation into suspicious deaths and overdoses of Dr. Loxley's patients.

At the time of the raids, Dr. Loxley said DEA agents were looking for controlled substances...substances he was not supposed to have because of a past run-in with the Board of Medicine.

In the June 22nd seizures, agents took 4,000 patient records and the hard drive from Loxley's computer.

The reason for the raid, as stated in a search warrant, indicated "Investigators have information that Loxley hides prescription medications in various locations at his home and office."

Loxley told WAVY News 10 last June that a group of relatives, former employees, and former patients have banded together to target him and are responsible.

"There are certain parties who are aggrieved at me over custody issues, over previous working relationships, over my finding out they embezzled from me ... (They) have joined together and made a complaint about me that is totally frivolous and fictitious."

Loxley admitted to 10 On Your Side he was not supposed to have certain types of narcotics in his office. In October of 2003, the Board of Medicine told him he could not dispense drugs like Morphine and Oxycontin, though he can prescribe them. The board put the restriction on Loxley because they say he had wrongly dispensed medication to his wife.

He says their decision is why he wouldn't keep those kinds of drugs in his office or home.

Loxley says, "They got nothing, unless somebody planted something somewhere, and eventually, they're gonna let me alone."

In announced the arrests Thursday, Paul J. McNulty, U.S. Attorney for the Eastern District of Virginia, said, "This case is about the betrayal of a doctor's oath to do no harm. According to the indictment, Dr. Loxley's prescription of drugs went outside the bounds of legitimate medical practice and resulted in the death of four people and the suffering of many more."
