Dr. Joel Hochman Responds to a Letter (withdrawn at the request of the author) on the NFTP website:

In my experience, people who proclaim their own morality and self-righteously condemn others are usually hypocrites. Prosecutors are often of this ilk. Recent studies have documented a high incidence of abuse and debasement of the law by prosecutors. Robert Weitzel encountered it in the sequestration of exculpatory evidence in his case (which resulted in dismissal of his conviction). Frank Fisher suffered similar abuse by his prosecutors. Often, even when confronted with DNA evidence of the innocence of their targets, prosecutors refuse to accept it. In virtually every case with which I am familiar, prosecutors have lied, distorted facts, suborned perjury from criminal witnesses, propagandized the public through the press and concocted false evidence. They appear to believe that their criminal means are justified by their prosecutory ends. Of course this is the essence of hypocrisy.

From a psychiatric perspective, these phenomena are best understood as the product of projection. As long as such a prosecutor is busy projecting criminality, evil and misanthropy upon their victims, they do not have to internalize and confront their own criminality. They rationalize that they could not be criminal because they believe that they ARE the law. This is the engine that drives all institutionalized criminal behavior - ethnic "cleansing", apartheid, genocide, pogroms, killing fields. On a smaller scale, it also the foundation for "legal" executions. (Murdering is murdering, even if it is obscured behind reams of legal documents and elaborate procedure.)

In fairness, however, we must note that only some prosecutors suffer such pathology. I have known many who legitimately seek to protect society and the law. Some are members of this List and they deserve respect and appreciation for their contribution to Society and the Law. I am sure that if the decision were theirs, scofflaws of any ilk would be brought to justice.

If your facts are correct about Mr. Brownlee, he should be prosecuted. But political connections mitigate against it. As that venerable legal adage states it - "it is better to have an inch of the Judge than a yard of the law." The National Foundation for the Treatment of Pain will, however, do its part in seeking equal application of the law to all. A copy of this entire posting will be sent to our 3,000 members, with a request that they send it to all of their friends and family, with a request that they do the same. Maybe if there is sufficient moral outrage about this hypocrisy, Mr. Bush, will have no choice but to act. It is the year of his electoral reckoning.
